1. About these terms

This website, totallybelts.com, is operated by Orbic Bearings Ltd, trading as TotallyBelts. We are a company registered in England and Wales under company number 01908580. Our registered office is at 187–189 Handcroft Road, Croydon CR0 3LF, and our VAT number is GB 407 6119 65.

These terms apply to every order placed on this website. Please read them before ordering. By placing an order, you agree to them. In these terms, "we", "us" and "our" mean TotallyBelts, and "you" means the person or business placing the order.

If you buy as a consumer, meaning for purposes mainly outside your trade or business, you have legal rights that these terms do not affect. Where a section applies differently to business customers, it says so.

2. Placing an order

When you place an order, you'll receive an email acknowledging it. This does not mean your order has been accepted. Our acceptance takes place, and a contract is formed, when we email you to confirm your order has been dispatched.

We may decline an order, for example if an item is out of stock, if we cannot deliver to your address, or if there is an error in the price or description. If we do, we'll let you know and refund anything you've paid.

3. Product information and fitment

We take care to describe our products accurately, including sizes, sections and machine compatibility. Compatibility information is given as guidance, based on manufacturer data. Before ordering, please check the size or code of your existing belt, or contact us if you're unsure.

Belts and pulleys should be fitted by a competent person, following the machine manufacturer's instructions, with the machine isolated from its power source. We are not responsible for loss or damage caused by incorrect selection, fitting or tensioning, or by use outside the product's intended application.

4. Prices and payment

Prices are shown in pounds sterling and include VAT at the current rate unless stated otherwise. Delivery charges are shown at checkout before you pay.

If a product is listed at an incorrect price because of an obvious error, we are not obliged to supply it at that price. We'll contact you before dispatching and give you the option to continue at the correct price or cancel for a full refund.

Payment is taken when you place your order. We accept the payment methods shown at checkout. Card details are processed securely by our payment providers and are not stored by us.

5. Delivery

Delivery options, charges and estimated times are shown at checkout and on our Delivery page. Delivery times are estimates and are not guaranteed, although we'll always do our best to meet them.

Items are your responsibility from the time they are delivered to the address you give us. Ownership passes to you once we have received full payment.

For orders delivered outside the UK, you are responsible for any import duties, taxes or customs charges applied by the destination country.

6. Cancellations and returns

If you are a consumer, you can cancel your order within 14 days of the day after it's delivered, without giving a reason. You then have a further 14 days to return the item. Full details, including how to return an item, are on our Returns and refunds page.

This right to cancel does not apply to belts cut to order to your chosen length or width, including timing belts and ribbed belts, because they are made to your specification. They cannot be cancelled or returned once cut, unless they are faulty.

The right to cancel does not apply to business customers. Returns from business customers are accepted at our discretion.

7. Faulty items

If you are a consumer, the Consumer Rights Act 2015 gives you legal rights if goods are faulty, not as described or not fit for purpose. You can reject faulty goods for a full refund within 30 days of delivery. After that, you're entitled to a repair or replacement, or in some cases a refund. These rights apply to all items, including belts cut to order.

Please contact us before fitting an item you believe is faulty or incorrect. We are not responsible for normal wear and tear, or for damage caused by misuse, incorrect fitting or tensioning, or use outside the product's intended application.

8. Trade accounts

Trade accounts are offered at our discretion. Credit terms are available to approved businesses only, subject to a credit check, and the payment terms will be confirmed to you in writing when your account is opened. We may change or withdraw credit terms at any time.

If a business customer pays late, we may charge interest and compensation under the Late Payment of Commercial Debts (Interest) Act 1998, and may suspend deliveries until the account is up to date.

9. Our liability

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited or excluded by law.

If you are a consumer: we are responsible for loss or damage you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care. We are not responsible for loss or damage that was not foreseeable. We supply products for domestic and private use. If you use them for business purposes, we are not liable for loss of profit, business, or business opportunity.

If you are a business customer: we are not liable for any loss of profit, revenue, production or business, or for any indirect or consequential loss, including the cost of machine downtime. Our total liability in connection with any order is limited to the price paid for that order.

10. Events outside our control

We are not responsible for delays or failure to perform caused by events outside our reasonable control, such as courier disruption, severe weather, supplier shortages or industrial action. If such an event affects your order, we'll let you know and, if necessary, offer you a refund.

11. Your personal information

We use your personal information only as set out in our Privacy policy.

12. Changes to these terms

We may update these terms from time to time. The terms that apply to your order are the ones shown on this website at the time you place it.

13. Law and disputes

These terms are governed by the law of England and Wales. If you are a consumer, you can bring legal proceedings in the courts of England and Wales, or, if you live in Scotland or Northern Ireland, in the courts of the country where you live. If you are a business customer, the courts of England and Wales have exclusive jurisdiction.
